Reference is made my previous anonymous query dtd 8 November 2019.
unsolicited credit card issued by ABN-AMRO 10 yrs back.Bank closed and taken over by Kotak Mahindra bank.no communication so far.suddenly a phone call telling a 420 case is going to be filed against me from Delhi Dwarka court.in reply my previous query all the Respected lawyer advised it is time-barred debt so criminal or civil case
can not be filed. But as the Kotak Mahindra bank is in practice of falsely implicating

Selling a property immediately after settlement deed

Dear Sir/Madam,

Could you provide some clarification on the tax implications for the following scenario please?

My parents and I are the joint owners of a flat since 1999. Due to advanced age, my parents wish to do a settlement deed and transfer the property entirely in my name. If I sold the property without doing the transfer, I get the LTCG benefits and can save considerably on taxes. Questions:

1) If I sold the property immediately after the transfer will it be treated as STCG and I do not get the LTCG benefits which means I could attract 30% of taxes from the sale of the flat?

2) Even if I retained the flat for two years and sold it later, the LTCG benefits will be very minimal since cost indexation is done only for two years, whereas without the transfer, the ownership is for nearly 20 years and capital gains would be much much less. Is this correct?

3) Or does it NOT have any impact on taxes if the settlement deed is done and I sold it either immediately or in the future since the ownership from 1999 will only be taken into consideration.

4) I have one brother (who is not a co-owner of the flat). Would it be OK if the settlement deed is done under my name only (since my brother has not invested in the flat in any way and the flat was purchased entirely from my earnings, not even with my parents' financial resources though they are co-owners). Or do I have to get a statement from my brother that he and his family have no claims over the property?

Best Regards,
Dr. S. Saravanan.

Property built by elder son on father's plot. younger son...

Good Day Sir
I had a notarized agreement on 18.05.1979 "Declaration by Father" which also bears signatures of my mother & my brother. I had 100% financed the construction with my remittances from abroad. My contribution when calculated vs plot works out 94%. We also had an amicable settlement on 07.09.1993 where I agreed to give my brother jointly with my mother G/Floor keeping 1st & 2nd floor under my possession. I have also paid electricity bills + house tax for 1st & 2nd floor till date. My father gave in writing in settlement this he will honour even in his last WILL. However my father's WILL 08.07.2010 did not honour his promise & changes it to 1st floor only for me. I have 100% evidence that this WILL was drafted by brother & written under influence with intent to cheat me. My brother claims he was posted in Bombay which he LIED as he was in Delhi & had brought our father to sub-Registrar office. Also I have proof the WILL was drafted 2-weeks in advance. Brother's lawyer comes up if WILL is not honoured then succession act will apply! What happens if a WILL is proven fraud? The status of my father & my brother at the time of construction was: Clerk (salary Rs 360 pm) & a trainee (salary Rs 600). They can not prove any other source of income / any bank FD's / any loan / I-Tax returns; but claim it was built in CASH by them. My father's BOSS have given a Registered Declaration Deed confirming the above. I have also case study records which prove that a property bought / built by investor on another family's name still belongs to the investor. Any signed photo copy document is also admissible as in a Supreme Court vs Punjab & Haryana High court judgement. Humbly seek your views on 'Conspiracy to Cheat' & 'Breach of Trust' by my brother who has forced my mother to join him; are my strong points. Engraved in US Supreme court: "Equal Justice for ALL" & mediation chamber #325 of Tis Hazari courts: :Tell the Truth & Seek the Justice" are my motivation factors. Thank You. GOD BLESS!
