Filing appeal in high court after 1.5years of judgment

(Querist) 02 March 2018 This query is : Open
Hi,

My husband and his relatives were acquitted in the dowry case 498a in the lower court in the year 2016 December. I had approached a lawyer for filing appeal in the high court in the month of Jan 2017. Unfortunately, the lawyer cheated me and took huge sums of money but dint file any case since she was not enrolled in any courts of India . I lost almost 1 year by the time I realized this.

But, can I still file for an appeal in the high court against my husband and in-laws?

Thank you

The appeal against the acquittal of the accused in the State criminal compliant case can be filled by the State through the Public prosecutor not by the informer/complainant.
The wife and her advocate should have moved application for the PP of the District Court for moving the appeal against the acquittal of the accused and insisted for it, but unfortunately the I'll informed advocate of the process made you suffer for one year and that cheat advocate took money from you for doing nothing.
Now you can just meet the PP and seek his assistance in taking action, but as there has been sufficient delay the filling appeal may not be possible now.

Thank you Vijay sir. Thank you Kapil sir.
One of you has said it is possible and the other says it is not possible anymore. I am unable to take a decision here...
