This query is : Resolved
Dear Sir,
My relative changed her name in 2006 after completing all legal requirements (gazette published in Aug 2006). Subsequently, she is known by her new name and the documents obtained after Aug 2006 such as PAN, Driving license, Adhar, Bank account, Voter id are in the new name. However, the academic certificates (10th class to post graduation certificates), which are very old (issued during 1994 to 2002 i.e. prior to 2006), are in the old name.
Last year, she admitted in a university for higher education and enrolled with new name. After completing annual examination, the university has denied to issue Certificate in new name stating that the student's name cannot be changed in the University record as she has not changed her name in the academic certificates (10th class to post graduation certificates). The university directed the student first to change her name in the academic certificates (10th class to post graduation certificates) then come to university for correction.
In this regard, my queries are as under:
1) Can university deny to issue certificate in new name even after having all legal documents required for name change, as all other authorities mentioned above considered the same and issued the documents in new name?
2) Whether issuance of certificate by university in old name, which no longer exist, would be invalid?
a clarification in regard to above from legal expert will be highly solicited.

The University's stand was correct. She has to begin change of old name to new name right from SSC or10t class and then proceed to inter, degree and PG etc. in which case University would have issued the certificate in her new name only.So let her change her old name to new name in 10th class first.based on Gazette notification.

There cannot be a definite suggestion to the problem highlighted. The University appears to be following their own logic and reason. Perhaps, the matter needs to be tested in a judicial review.

Not a legal problem.
By the way, what was the secret in your query that you have kept yourself hidden and asked the query as any anonymous person? From whom you are afraid of, where your question was of general knowledge about education system?

Your query seems merely a hypothetical academic question. When you say that the candidate appeared with new name, how do you believe that the university would issue certificate with old name? Secondly, a question of commonsense, when he does not have any previous academic record in the changed name, how the university allowed him to appear with new changed name? Rather it is a matter of investigation, how the university issued Roll No. & hall permit to the candidate, when there existed no record of the academic qualifications in his new name.
That question on your part, itself denotes that you do not have any real problem, but are seeking solution to your academic query.

Thanks for valuable advice given by Experts. But, I am not clear about the following:
1) In my case as explained above, issuance of certificate/degree by University in my old name, which no longer exist legally, in current date would be valid? In this context, it is pertinent to mention that subsequent to name change, other authorities has issued various documents such as Driving License, PAN No., Adhar, Voter Id, Bank accounts etc. in my new name and have been considered by various authorities as valid.
2) whether it is mandatory to change name in all certificates i.e. 10th, 12th, Degree, PG, which have been issued prior to name change, or attaching gazette notification would be sufficient while submitting documents for any employment (as the application has been submitted with new name).
Please reply to the above queries which would help me a lot.

In your case University shall have to concede your request and cannot deny your documentation work done which should be done lawfully. Whereas, change of name in previous and SSLC record may not be possible but rest of other pursuing record may carry the new name. While, university issuing old name may have adverse effects thereafter your declaration of new name.

Query answered by the expert. Assumingly repeated query apparently to expose the legal knowledge
