Police verification

(Querist) 25 May 2021 This query is : Resolved
My friend was riding without wearing helmet . He got spot fined rs.500 and police let him go. Will that fine affect him for joining government job and police verification?
K Rajasekharan (Expert) 25 May 2021
Payment of such a fine will in no way affect his future in government job.

Fine is a fixed sum of money to be paid as a compensatory amount against breaking a non-criminal law or rule in force such as motor vehicle law.

It is imposed as a civil form of penalty or punishment on a wrongdoer in order to penalise him and deter him from doing it later. Such fines are imposed only on non-criminal offences which are not considered as serious as criminal offences.

It is not equivalent to or quite different from any penalty (sometimes it is called as fine also) fixed as per criminal law, mainly the Indian Penal Code (IPC) The three offences the service rules take as serious ones are serious crimes, and offences concerning moral turpitude and financial matters.

Thank you very much sir 🙏 🙂
Advocate M.Bhadra (Expert) 25 May 2021
It is a fine case and will not any effect at all to get his government service.
T. Kalaiselvan, Advocate (Expert) 25 May 2021
Section 129 of the Motor Vehicles Act is targeted at two-wheeler drivers and states that driving/riding a two-wheeler without wearing a helmet is considered a traffic violation and is an illegal offence in the country. The punishment for anyone caught without a helmet while driving/riding a two-wheeler can go up to Rs 1000/- along with the suspension or seizing of the driving licence. In some severe cases, the driver can be imprisoned for up to three months.
However since your friend was let off with a penalty of Rs/. 500/- alone, uit cn e considered as a petty case hence it may not reflect in the criminal records, your friend need not be worried bout the police verification for his future employment because this may not reflect in the verification report.

Yes. it is only fine and not affect Government service.
Sudhir Kumar, Advocate (Expert) 26 May 2021
Such petty offences do not count.
P. Venu (Expert) 26 May 2021
Yes, the fine imposed has no adverse effect; but furnish true information, IF SOUGHT.
Dr J C Vashista (Expert) 28 May 2021
Well analysed and advised by experts, I concur.
Mahesh Jad (Querist) 01 June 2021
I understood your answers sirs, but in police attestation form they asked have you ever paid fine under court of law? What should he say, yes or no?
T. Kalaiselvan, Advocate (Expert) 01 June 2021
Since these reports are not reflected in the police records, to be on the ser side, you may avoid mentioning about this fine amount instead of complicating simple things by making a mention about the incident which took place long ago.
