It is not possible to vacate the exparte order on the first date in absence of respondent.

What is your locus standie to the ex-parte order?
What were the circumstances for passing ex-parte orders by the Court, which is (normally) impossible?
You, yourself are responsible for sarcasm by posting the question without any identity as well as head and tail.

Sir I apologise if I have offended u by any chance what I meant through my question was that if on 1st date the respondent doesn't appear and the case has been proceeded for exparte hearing on a subsequent date then if respondent seeks exparte vacation on the subsequent date do courts generally allow.
