    Sec.338 is for injury caused without intention, u didnt understand what is problem exactly, read query, it is about mischeif, sec 427 is for mischief/damage of more than 50/-, in motor accident this section is applied. It is argument that there is not intention to cause this damage in motor accident, then why this section is applied. You will find almost all accident are u/s279, 427.... ipc. so what is validity of application of this section.

    thank you for the clarification. In a claim for arrears of maintenance under HMA, where the husband has a meagre income of Rs.600/- and no property in his name, what is the remedy for wife? she has not filed the case u/s.125, Cr.P.C.
