  • Member (Account Deleted) says : tampering with the marks in UPSC Examination
I am writing to seek your guidance and assistance in one of the cases that we are dealing with right now and finding it difficult to proceed further in absence of an appropriate case law on the subject matter. My client appeared in HAS examination and attained 599 marks whereas the top ranker attained 607 marks in total. She has scored above 70% marks in every subject except for hindi language paper in which she was able to score 39 marks only (the passing marks being 40). The answer sheet acquired through RTI reveals that my client was failed in the abovementioned paper deliberately owing to the fact that clear overwriting was done by examiner while checking the paper. We are in search of an authority which can convince the court that the answer sheet be produced in the court for examination. The tampering with the marks in the answer sheet has to be proved in the court so that my client is able to sit for the interview. I shall be highly grateful to you if you can help me out with this case.

  • varun says : Unfaithful girlfriend
Sir, I saw your profile on www.lawyerclubindia.com I have an Issue, I would be greatfull if you can suggest me some thing. Issue: I had a girlfriend. We were planning to get married this year. Our relationship was very deep and intimate. Suddenly from last 1 month or so she changed her mind and started refusing to marry giving feeble reasons. I tried to convince her but she and his younger brother are threatening to lodge a false complain against me that I have been stalking and harassing her mentally. We were having sexual relation and it was her who initiated. My query: If she lodges a false complains, to counter it, can I lodge a complaint against her for physically exploiting me by promising to marry me?? I read many times in the newspaper where woman are lodging complaint against men on the above bases, under the charges of rape. Can it be applicable vies- versa? I no longer wish to marry her. I have some of her photographs, 100s of SMS and some videos by which I can prove that we were having very close relations. Thanking you. • Nayana says : Flat registry
I wish to have guidance on few queries of mine Sir. I am Nayana from Pune . My husband and I had booked a flat which was under construction. The alottment letter carries both our names and it is the time for registry now siince the flat is ready for possession. We are going through a bitter phase in our married life. He had wanted separation from me since a long time as he wanted to get married to someone else. At that time I had asked him to provide me and my son at least a permanent house where we can take shelter and have some property in our name. But I always tried to give the marriage another chance and became emotional and booked the flat in joint names. The loan is on his and my name. I since then have been trying to make things work but the bad treatment on his part continues. My question to you is that if he provides a mail or a letter stating that the registry be made in my wife's name would that be ok legally to register the house in my name or what else is the procedure? Pls guide. Thanks.

  • fighting back says : can anything be proved under oath??
dear sir I have read a number of times in this forum from experts that anything can be proved in the court under oath, which should not be impeached during cross examination now, suppose an opposite party, is hell bent on nailing the opposition to trap him in a false case, may lie under oath and his lawyer will make him 100% trained so as to not let him fail. so what can be done in such a scene. if a person lies under oath, and also manages to pass the cross examination and he is lying under oath, which only the opposite party knows, and he has no proof. then IS HE NAILED?? is it so easy to trap a person by just lying under the oath and making sure 100% to pass the cross examination? thanks

  • Shah Mahesh says : unregistered documents
I have a query and will be grateful if you can share your views on the same. I am the 3rd owner of a flat in a registered CHS and staying there since the last 18 years. The 1st owner who purchased the flat from the builder has it registered but the 2nd owner and myself have not registered the property (stamp duty has been paid in all the 3 transactions). Will there be any difficulty in case I find a buyer who wishes to avail of a bank loan, since the property is not registered?, Thanking you in advance.
