  • archana says : Sir , Please help
I work as an Inspector(Grp-B officer) in Central Government and am 5 months pregnant at present . I am suffering from various prenatal complications in my pregnancy . I applied for leave with MC on 3.8.2011 (MC by AMA)and next day onwards i.e.4.8.2011 , there was a strike called by Group C & D employees' union. Due to severe problems I could not travel to office I was assigned charge ,which was 150 Km away from my HQ.On persistant requests also higher officers didnot pay heed to my genuine request and also didnot convey me any message in this regard till today i.e.24.8.2011. On 3.8.2011 , I was admitted to a private hospital and doctor has adviced me to be on continued bed rest for another 15 days i.e. from 18.8.2011 onwards again. Now, my post has been relocated to another city and I am directed to immediately shift the office and attend duty failing which office will consider entire period as unauthorized absence apart from disciplinary action. At present , It is nowhere possible for me to shift my location due to my husband being posted in same city ,my home being here and my first child to be just two years old. Also, no much medical facilities are available in that city. Please tell , 1. is there any rule which abide my office to have at least intimated me or should have corresponded me regarding denial /approval of leave? 2. Is there any deadline for leave saanctioning authority to ask for second medical opinion? 3. Even on timely submission of documents and genuine problem am I liable for unauthorized absence or disciplinary action ? Please guide and help

  • MAAJIS says : PROPERTY DISOLUTION MATTER
Between the partners on their landed property there was an partnership agreement been made on 50 : 50 ratio as both the party owed the property to equal extend i.e. 100 cents ( 50 + 50 ) As per the agreement one of the parties was made to be accountability for the construction activity, to maintain all records, As on books one of the partner( A) paid 50% of the construction cost to another partner (B) before the registration deed could come into existence, thereby the other partner showed only 12% on books and the balance on the other for the construction cost, the same was shown as balance due in the agreement too as due .. Well at a certain stage the construction was stopped and after a period of 4 years , the latter partner (B) filled a arbitration suit , claiming for accounts and dissolution of the firm During this course of arbitration he(B) claimed for public auction and won the suit as against meets and bounds under 2:1 judgment , further it was appealed in the lower court , there also the order was passed for public auction ( both parties were private individuals ) Latter when the first party(A) who had paid 50% on account the other party ,appealed to high court , where in the order was passed - As both the parties shall take their own share back as land and building as is where in condition as on date and as per their own sharing ratio back to them Well the question comes is whether the accountability for the amount invested is refundable or not and if so what rate of interest is claimable on the same . On the High court the first order was passed , to share the land and building as per their ratio and to retain in whatever fashion required , whereas while claiming for the amount the matter was posted and so far nothing is coming up other than the dates Pls guide me , we have almost lost most of our self on this …… i would like to update if the payments made for the construction and come to stand still later after the judgement was realised the oders where distribution of the land and building only whereas the intial capital been made is that amount claimable or not is the question fight for the same is worth the trial . pls guide

  • Vinod says : Passport act
Dear Sir, My friend applied for passport & has got the passport. but the problem now is that the light bill submitted to obtain passport was forged & now the CID has called him and told him to give original light bill of current month & one year back dated. It is not possible to get the original bill. 1) So what are the legal consequences & penalty/punishments for this offence? 2) What are the procedures to get out of this mess? 3) what will be the legal battle if he has to fight with the authorities? 4) Can he be pardoned if he accepts his offence & surrender the passport? 5) Can he apply for a fresh passport thereafter & will he be able to get it?
