    sir many day ago i write you about my fathers mact case.sir my father's accidented in near 2003 his left leg was not working not fold his leg. when he walked support with stick or walker. today 4 years ago he death as heart attack. his monthly income near 25000-30000.so how much money we claimed and allegable for this? answer me sir as per court we get 30000 for first time and made it f.d as rules.now our case is not on board so what we do sir? advise me....

    'X' is a monthly tenant from the year 1974 in respect of 5110 sft non-residential premises in kolkata, West Bengal. The rent at the commencement of the tenancy was Re 1/- per sft ,i.e., the monthly rental was Rs. 5110/-. In 1991 'X' and the landlord mutually decided to increase the total rent to Rs. 11,000/- , i.e., by additional payment Rs. 5890/- nomenclatured as 'service charges'. Since then the 'X' has been paying Rs. 11,000/- per month. The Rent Control Act in West Bengal underwent changes in 1997. West bengal Tenancy Act 1956 was repealed and the the new Act, West Bengal Premises Tenancy Act 1997(ammenreded 2002) was enacted. The new Act set an outer limit (for rent) of Rs. 10,000/- for including a tenant under West Bengal Premises Tenancy Act 1997. My clarification are as follows: 1. Under which Act does the tenant presently come under? West Bengal Premises Tenancy Act 1997 or Transfer of Property Act or any other Act? 2. Assuming the tenant comes under Transfer of property Act: i) Can he be made liable to pay fair rental in the Courts. Market rentals have become as high as 100/- per sft in the building in which the tenant is situated. Is there any provision for fair rent revision under TP Act? What is the legal procedure for rent enhancement. Is a valuation report of an Court registered valuer required to be submited before the Court. ii) Can the lanlord file an ejectment suit under TP Act against the tenant by giving him 15 days notice without having any reasonable grounds?

    i was in a relation with a girl for around 8 months and both of were committed and wanted to get married. But it was decided that first we will know each other and if anyone of us felt that our relation won't be a success we shall directly discuss it and we are free to discontinue the relation. I even talked about this to her mother that we are trying to know each other and if we feel that we can live together then we will approach to them for marriage and she agreed to that. We used to have a fight frequently [only verbal fight]. And i told her that i'm not comfortable with this debate kind of conversation and if it continues then i won't continue. My x-girlfriend said that every thing will be ok with time. But there was no change and we started to have verbal fight every now and then. This made me uncomfortable and i directly told her that i want to quit and gave her the reason. She made every possible attempt so that we may continue but i said i don't want to continue and finally we decided to move on with our life. Due to excess mental stress i was admitted in hospital for 3 days, and i have every document regarding that. But i never blamed her and i didn't even bother her or her family and neither my parents or known ones gave any trouble to them regarding my medical situation. But after a month my x-girlfriend sends me sms saying "i love u come back". I replied that we have decided on things and now there is no use on discussing things again. Next day she calls me again saying the same thing and my reply was same. On that very day she send me sms and i replied to them but then she started misbehaving and called me "gay" and "late mr. parmar", upon getting such sms i didn't reply and she stopped sending sms after sometime. still i didn't complain about it as i thought she is upset thats why she is using foul words. At night around 11:15 her mom calls me up and says that her daughter [x-girlfriend] is in hospital and she kept on blaming me for that. I tried to tell her that what went wrong among us but she was not at all ready to accept her daughter's mistakes but she put everything on me. Finally i kept quiet and she kept on talking. She said that if anything happens to her daughter then she will ruin my life and not let me live peacefully and kept on giving me such threats and then disconnected the phone. Sir, i want to know that is it legally possible that she can sue me over that? That girl and me have not met each other till now we used to either chat on web or talk on phone. There has been no physical contact among us. So case of physical harresment can't be filed against me. Is there any other legal action that she can take against me. Doctors have adviced me not to take any kind of stress and i'm in much pressure due to their behaviour. So is there any legal action that i can take against them? If any case is registered by anyone of us then who has a strong side, that girl or me? I'm waiting for your precious advice and show me the correct way out of this situation. Thanks in advance.     We have issued sarfaesi 13(2) notice. borrower replied against the same, but we failed to reply that within the prescribed period of 7 days u/s 13(3A). Can we issue a fresh notice u/s 13(2) again. if not what is the remedy
