    Dear Friends Our firm is based in Agra, we had a business dealing with a firm based in Delhi. All the transactions were done in Agra i.e. supply of goods, receipt of payment by cheque. But, as our Bank is CBS, the cheque was deposited in party’s bank in New Delhi. The cheque was dishonoured and we filed a suite under section 138 & 420. In the last hearing at the time of arguments, the judge told us that the suite falls under Delhi’s jurisdiction, as the offence was committed in Delhi and he mentioned about a ruling of Supreme Court. Will appreciate, if some learned friend guides me, whether the suite is maintainable at Agra or not. Secondly, suppose it gets rejected at Agra, are we eligible to file a fresh suit in Delhi, as the suite is 4 years old, will we get the benefit of limitation or not,.( We mean that will the period of litigation in Agra court will be counted or not. Will be grateful, if some noble soul provides us any ruling of any High Court or Supreme Court,in this regard. Thanking you & with Best Regards . SUKRIT

    sir first i have one plot of 95 gunta .then i have divided a plot in A (55 gunta ) and B(35 gunta) i have town planning saction plan for both the plot.i have done land measuring of my plot B and is approved by land department for 35 gunta.The issue is regarding plot A .their project has been completed 10 year back and society was form in 2007.while making society we have mention boundry in agreement.But on later in 2009 they have done land measuring on in which only 42 gunta was been seeing i want to ask sir if land on 7/12 is 55 gunta and actual land is 42 gunta then how will be the issue solved.does the government will approve only their 42 gunta?.

    Sir, Our property was fraudulently partitioned in the name on one fictitious name and later was encroached and an illegal construction was carried by another claiming the fictitious name to be of his father. could I please be guided what can be done to recover this property?

    My bank has taken possession of my movable assets under SARFAESI. They are perishable in nature the bank is supposed to take steps for their preservation but bank is not taking any steps inspite of my requests.
