Respected Sir/s, Sub: Prayer for considering the application made by Sri. Sudipto Bhattacharya, on 2nd January, 2008 son of Late Sarnath Bhattacharaya, a Progm. Exe Doordarsan Kendra, Kolkata, died in harness for appointment to the post of Group-‘C’ or ‘D’ on Compassionate Ground. With due respect I , Sri Sudipto Bhattacharya , son of Late Sarnath Bhattacharaya wish to submit my humble prayer before your good self that my father Sarnath Bhattacharya since deceased was a permanent employee of Doordarshan Kendra Kolkata, who served DDK in the capacity of Programme Executive since 1994. After serving Doordarsan Kendra Tura for a period from 2002 to 2004 and Santinikatan Doordarshan Kendra, he was finally brought back to Kolkata Doordarshan Kendra, but due to his ailing physical condition did not permit him to continue to work in the office and even in spite our best effort in all respect for his survival he died intestate on 15th April, 2007 after suffering from acute motor neuron. That my father leaving behind myself as his only physically handicapped child and my widow mother Smt. Minakshi Bhattacharya in grim condition, as because due to prolonged medical treatments of my ill fated father , we incurred and incredible volume of money for his treatment. It will not be out of place to mention here that Medical expenses bills paid towards treatment of my father at A M R I Hospital, Kolkata for the period from 26.01.2007 to 09.02.2007 amounting to Rs.6, 00,000/- (Rupees Six Lac) only and at Ruby General Hospital, Kolkata of Rs. 6,50,000/- (Rupees Six Lac fifty thousand )only for the period 10.2.2007 to 15.4.2007 ( all the original bills were submitted to Pasar Bharati for reimbursement of medical expenses) against the above mentioned medical expenses the Prasar Bharati , Doordarshan Kendra, Kolkata reimbursed only Rs. 2,98,816/-(Rupees Two Lac Ninety eight thousand eight hundred sixteen) only after the demised of my father. My mother had to borrow money from friends and relatives, even from the market to pay the total medical expenses of the Hospitals, amounting to Rs.12,50,000/- during the treatment of my father , for that we are now badly indebted to many persons under compulsion to repay the loan amount . At present I am 32 years old a physically handicapped person due to hearing impaired since birth and as per the handicapped Certificate No-NH/HB/196/46 dated 16.12.1998 issued by the Government of West Bengal Handicapped Board, Nilratan Sarcar Medical College & Mospit, Kolkata, 40% (forty percent) partial disability calculated, and the Certificate issued as per Order No-HF/O/GA/107/02/98 dated 15.01.1998. Moreover I have practical knowledge and experience in Computer application in Win98, MS Office, Accounting Data Entry, DTP, Graphic Software’s, Corel Draw 9, and MS DOS etc and due to physically handicapped I, am debarred from getting a suitable job to maintain myself as well as my old mother. After the demise of my father I made an application on 2nd January, 2008 to the office of Deputy Director General, Doordarshan Kolkata, for a job on Compassionate ground, and the Administrative officer, Prasar Bharati, Doordarshan Kendra, Kolkata was kindly forwarded my said application with all supportive documents to the Director General (S-II Section), Doordarshan, Mandi House, New Delhi vide his letter No-KOL-TV-7(1)/2006-A-III/376 Dated 18.01.2008. That on 9thAugust, 2010 my mother received a Office Memorandum No-3/20/2010-S-II (A)/880 Dated 31.07.2010 from The Deputy Director (Admn),Prasar Bharati, Directorate General Doordarshan, New Delhi , asked her to give in detail how much amount She received from Prasar Bharati, Doordarshan Kendra, Kolkata towards death benefits of her demised husband Late Sarnath Bhattacharjee , as a dependent wife. After received of the above memo my mother wrote a letter on 12th August, 2010 giving all the details of amount received by her in seriatim to the office of the Deputy Director (Admn) Directorate General, Doordarshan, New Delhi. She also mentioned their that there is no other source of income of the dependent family of Late Sarnath Bhattacharya , except monthly pension amount. Moreover she also declared that her son is a disable person not working any where for gain permanently or earn any amount for her family. Beside this we are also deprived of Central Government medical facilities (C.G.H.S) till date and every medical expenses and/or treatments have to bourn by her from the monthly family pension amount. My mother having no other alternative personally met Hon’ble Minister of Railways and submitted a representation dated 7th January 2011 and humbly requested Smt. Mamta Banerjee, Hon’ble Minister for grant of an employment to her disable son Sri Sudipto Bhattacharya on compassionate ground in Indian Railway or in D D K/Kolkata and which was forwarded by the Private Secretary to Hon’ble Minister of Railways on 28th January,2011 to Sri Ranjan Prakash Thakur, IRTS, Private Secretary to Hon’ble Minister of Information & Broadcasting, Government of India , and requested him to consider the matter in suitably. That on 4th April,2010 and 5hth May, 2011 respectively my mother received two letters from the Deputy Director (Admn) Prasar Bharati, Directorate General, Door darshan Bhavan, New Delhi vide Letter No-3/8/2008-S.II (A)/341 Dated 19/30.03.2010 and Letter No-3/8/2008-S.II (A)/590 dated 13.04.2011, informed that as per the DOP &T’s guidelines contained in their O.M No-14014/19/2002-Estt,(D) dated 5.5.2003 the case of Sri Sudipto Bhattacharya was considered but was not recommended for appointment on Compassionate ground without giving any valid reason why my candidature was not recommended by the Compassionate Appointment Committee (CAC). The objective of the Scheme for Compassionate Appointment is to grant appointment on compassionate grounds to a dependent family member of a Government servant dying in harness or who is retired on medical grounds, thereby leaving his family in penury and without any means of livelihood. It is to relieve the family of the Government servant concerned from financial destitution and to help it get over the emergency. Keeping, in view the objective of the Scheme, the existing instructions relating to Compassionate Appointment have time and again been reviewed/ modified /simplified so that the system finally derived at shall be more transparent, efficient and uniform in nature. The efficacy of the Scheme is based on its transparency. It is this aspect, which is fore most and hence while considering a request for appointment on compassionate grounds by a Committee a balanced and objective assessment of the financial condition of the family has to be made taking into consideration its assets and liabilities and all other relevant factors such as the presence of earning member; size of the family ages of the children and the essential needs of the family etc. I would like to mention here the Review of Scheme for Compassionate Appointment in the light of the 6th Pay Commission recommendations. I quote “Vide O.M No-14104/6/94-Estt. (D) dated 9th October 1998, it has been decided in consideration with the Department of Expenditure that for appointment on Compassionate grounds, in exceptional circumstances Government may consider recruiting persons not immediately meeting the minimum educational standards. Government may engage them as trainee who will be given the regular pay bands and grade pay only on acquiring the minimum qualification prescribed under the recruitment rules. Under the aforesaid circumstances I am once again requesting you to consider my application for an appointment in any grade on compassionate ground, so that I can earn some thing for myself and my mother otherwise we will die and unable to overcome from the acute financial stringency , which we are facing till date.     I am working in a uk based mnc company ,were i have joined on 11th june 2007 and now i have put up my resignation and planning to get relieed on 11th feb 2012 (ie after completing 4yrs,8 month,1 day or 4yrs+246days) and i was having one day of lop (loss of pay) from the above said period Do i have eligibility for the gratuity benefits??

    Hi My family force me to marry a girl i never wanted. i went to her place i siad her i dont want this marrage but her family came with 12 people they siad if i wont come they will kill me. now am fighting in court since 9months. but i cant see end of this why is taking so long ? can u advise me what to do maby i shoud change my lawyer? do u have experience in smililar case?
