    Hello Sir I have been married for 9 years now and staying separately from my wife for the past 18 months. I have a 6 year old daughter as well who is staying with my wife. The problem in our marriage is that my wife does not like staying with me and was diagnosed with Multiple Sclerosis within 15 days of marriage after landing in US, which was a preexising disease and not disclosed before marriage. After great persuasion by her and her parents that they were not aware of the disease before marriage and thinking that if any spouse gets sick after marriage, that is not the ground of leaving or looking for divorce. I accepted her by leaving my job in US, came back to India and started living together. Over a period of years, I realised that She is very adamant, non-adjusting, agressive and does not like staying with me and my family and in the past 9 years, we have only stayed together for 5 years and that too in an unhealthy environment. we didnot have had any physical relations for the past 6 years. So far I had been adjusting for the sake of our child, but finally i gave up and decided to stay separetely so as the child does not grow in an atmosphere where parents are always fighting. She lives at her own terms and whenever there is a need for adjustment, I always adjust and when she needs to do anything which she doesnot want, she threatens to commit suicide and did tried once, but I came at the right time. Owing to above, I finally decided to stay separately and I am living separately for the past 18 months now. During our separation period, I discussed with her for mutual divorce to which she disagreed along with her parents that she doesnot want to resettle and doesnot want me either to live a normal life, she is happy living her life with the child and doesnot want to remarry and just wants me to pay for the child and keep on meeting the child. I have the following evidences/grounds with me for filing the divorce case for cruelty and desertion: --I have been paying the maintanence of child expense for Rs 5000 into her bank account for the past 18 months. -- Cyber complaint against her ruining my character on facebook and forging my mail accounts --Cruelty case in police station as an evidence that I am staying separately from her due to her suicidal behaviour and agressive nature. --Multiple Sclerosis reports from the US hospital when she got sick within 15 days of marriage. --Canada immigration declaration given by me so that she can take the child along with her and I have no objectiions to the same. --Original receipts for All items like gold etc taken back by her. In lieu of the above, kindly advise me how much time it will take me to get the divorce from my wife, we both are working and are financially independent. Also guide me how much I need to pay for the divorce settlement..... approx.

    Hello, I am from India and got married in 2006 and since then my wife has been under depression and on medication. She had regular attacks of depression and that disrupts the entire life of various family members (including her parents). She was under depression before marriage as well but their parents did not disclose the same at the time of marriage. Recently she has been diagnosed with paranoid schizophrenia by a good mental hospital in India. I have asked her parents to look for a mutual divorce which they and my wife, both have rejected. She has not been staying with me for last 8 months and all her attempts to come to my house has been rejected by me. However, since she is on medication, she behaves normally but never know when the attack may happen again. What are the legal options and grounds I have for divorce? Is 2 year separation period necessary for getting divorce or can I apply after 1 year of separation? Since I am not allowing her to stay with me, can I apply for divorce after 2 years of separation?

    A, B & C were brothers belonged to hindu undivided family, they had immovable ancestral properties, and they had joint business firm. In 1954 due to differences they came to a conclusion for a final settlement with regard to the immovable properties. All of them had minor male issues at that time. On going through the accounts they found that the share of assets of B & C was equal to the share of liabilities in joint family business firm. So, B & C found that it is not possible for them to continue as co-sharers of immovable properties. So, they executed a release deed (themselves and on behalf of there minor male issues)in favour of A alone (the names of minor male issues not mentioned in the deed} and gave up all rights and interests in entire immovable properties for which each of them received Rs.4ooo/- as consideration from A for the benefit of minors. My question is- by paying consideration to B and C did the entire ancestral properties became self acquired properties in the hands of A? Does it remains as ancestral property with regard to male issues of A?

    Sir, section 4(2) of Hindu Succession Act 1956 is omitted with Act 39 of 2005 dated: 05- 9-2005 Section 4(2) was :- "For the removal of doubts it is hereby declared that nothing contained in this act shall be deemed to affect the provision of any law for the time being in force providing for the preventation of fragmentation of agricultural holdings or for the fixation of ceilings or for the devolution of tenancy rights in respects of such holdings". now sir my father was a Bhumidar as mentioned in the FARAD of my delhi land .... so what is the current status of a Bhumidar in delhi.... Can he make will on his agricultural land in name of only one of his legal heir.... or the ancestral law(as mentioned in hindu succession act) that it will be divided among all the legal heirs... pls reply....
