    Dear Sir I am K’s Son (Property Agricultural Land in Badnagar, Ujjain Dist) • G: Acquired the Agricultural Land around 1900-1930 AD • H + M + T: = Three Children of G (H & M = Sons & T = Daughter) • H = Started Agricultural Activities on that around 1940 & Continued the same till his death in 1990 • M + T = Filed claim over the land during life time of H (That M & T= either won or it was settled then) • A + S + K = Three Children of H (A & S = Sons & K = Daughter) • A = Eldest Son of H took possession of the Land after death of H in 1990 • K = Daughter of H died in 1991 (Wife of H Also Died in same Year) • S = Brother of A continued to demand his share in Land to A • Recently A sold the entire Property very cheaply & nothing is left now = this is what A claims now. • I am the Son of K when got this news I searched for the details of Property & I got following details • As per the Land Records of FY 2011-12 Property was registered in following names • 24% = Name of “S” & 26% = name of “A” (18% = A’s Wife, 18% = A’s Son, 14% A’s Married Daughter) • A Claims that he has sold the entire property Recently Very Cheaply (Around March 12 but he hasn’t disclosed the figure) Other Information Which May Be Relevant To This Case 1. “A” Claims that one portion of land was given by G’s Wife directly to him & he won’t share it with anyone. 2. Once when my father (died in 2008) asked A about my Mother’s Share in Land (“A” said Wait for Disposal of Land) It was around 2004-05 3. I suspect A has sold it at undervalued Price around March 12 to the Person at who’s place he works (I mean he sold it in blank that is what I suspect) 4. A said that I have also paid some (nominal, if compared with value of Property, I guess) amount to M’s Sons after disposal of Property 5. As per “Khasara” on which A’s name is there: One date appears 30.08.2005 (Is this has some connection to Hindu succession (Amendment) Act 2005 Which is effective from September 2005) Other “Khasara’s” Containing Names of S & Wife, Daughter & Son of A do not contain any date) My Questions & Queries 1. Can We (Me & my two married Sisters) Claim my Mother’s share in the Land from A & S 2. If Yes. Can we File Suit to Cancel the Sale Deed (as our permission was not taken) 3. Whether Hindu succession (Amendment) Act 2005 will apply to this case. 4. How to get the certified copy of the sale deed of above property. How much it will cost to me? Thanks & Regards

    author : rajesh Posted about 22 hours ago in suit for bare injuction the trial court errored by decreeing then we approached senior as RA there appelete court reversed trial court ordered in our favour. It was ordered in our favour in high court, karnataka & supreme court of india in our favour. Now they have approaced first time suit for posession as thier name are in extract copy but dont have blue print who constructed the shop. Brief fact of case- The suit is multi storied our posession is in ground floor from 1971. suit is of ground floor and opposites are in first floor. now the query is of adverse or limitation. We have not put counter claim. We only want case to be dismissed. so request is for citations and any good sugesstion or documents. Pls. help

    Hello sir, I am Shivakumar from karnataka my father is central govt employee in NMDC iron ore mine sandur (tq),Bellary (dist). Desigination:Master Mechanic grade 1 ,Sir my issue is as my Dad directly recruited as as welder which is group D or less and after age 40 he comes into class 1 officer,as per my knowledge based on this I should get a OBC Non creamy Layer certificate.but when we applied for OBC certificate Tahsildar asked for salary slip according to him we wont come under non creamy layer and he says he dont have a document from govt. stating that at before age of 40 if person is class 3 or class 2 he will be consider as non creamy layer.I tried to provide him the details of this by showing a document on this available in NCBC(National Comission for Backward classes) but he did not accept it.I am helpless now.Could you please guide me how to get my OBC(Non creamy Layer) certificate.     Nikhil92012@yahoo.com says : Divorce Summons Issued - Mentioned Door Locked Sir, Court issued Divorce Summons Under Sec. 13(1) (ia) (ib)and sent through a Court Clerk, but sent back stating Door Locked on May 2012. My Wife is a Govt. Doctor and very highly qualified Post Graduate. I studied a science post graduate degree and unemployed atpresent. SUBJECT : I WANT MY WIFE AND CHILDREN BACK AND LIVE WITH ME - REUNITE. I CAN AFFORD ALL THE EXPENSES OF THEIR LIVING. My wife had left me on Jan 2010, after having an Extra Marital Affair, by means of a harassment complaint on me to PS by their parents and her and we got separated on Jan 2010 by writing an agreement in the PS for one year separation. At the time of separation our married life was 7 Years 2 months. We have children, Son(9 Yrs), Daughter(7 Yrs). She took away all her valuables,belongings etc., as per the agreement and all were noted on a stamp/bond paper and notary done. Her Father took away my children along with my wife and the same were mentioned in the agreement. After one year as per the agreement expired I called her many times for reunite, but she was reluctant to join me. The person she had an affair is 10 years younger to her and got married with a girl in their community in 2011. She disappeared and roaming with her lover and her whereabouts were unknown, for one and half years. She had not shown me the kids for one and half years. She does not lift the phone and their parents as well not cooperated and not even lift the phone and talk to me. After one and half years from agrement my wife came to me stating that she has changed completely and there were no affairs and will reunite with me after one and half years on June 2011 from the agreement date. It was all a drama, she cheated me again and she is living separately with children. We met occassionally at my residence, restaurants, and at her house(She is living alone with kids) from June 2011 till March 2012. Since April 2012 she is not allowing me to her house and not showing me the kids. I heard she started a new affair with somebody else and came to know plans to marry him. Now on May 2012 she served me court notice for DIVORCE, ALIMONY and Maintenance for Children. How to follow up the case. I do not want divorce. I have phone records of her affairs and agreements of separation and valuables, belongings given to her on bond paper notary done. Please let me know how to follow up the case. In her petition she mentioned all false things about me like I drink and beat her(I am not a drinker and I never drink and beat her), harassing, property harassment (No dowry taken), Suspicious etc., and Alimony and Maintenance for Children.     HELLO SIR'''I M LLB 3rd sem student..i have to prepare for my first moot court presentation..so i need ur help..The problem is as follows On 2nd January,2005,the SKIMS Hospital Srinagar declared Abdul Ahad as brought dead.On that morning the village committee(name of village SAGARAMA0 had started raiding the houses in order to capture the heating appliances which caused overloading & hence disruption of light in the whole village. During the raid the village committee mostly collected the heaters used for cooking purposes. On reaching house of Jamal ud Din, the accused Kabir Khan intervened & told the village committee that Jamal ud Din being a poor man, he should be allowed to use heaters for cooking purposes on humanitarian grounds. On this, the deceased namely,abdul Ahad who was also the president of village committee replied that the decision of village committee applies on all & none shall be allowed to use such heating appliance. The accused & deceased exchanged words which escaped in hot talk. The deceased blamed the accused that you are covering the Jamal ud Din as you have intention to grasp his two marlas of land adjacent to your house. The accused suddenly caught the neck of deceased & hit his head thrice with an earthen pot ( called KANGRI) . the Accused ran away & deceased chased him. the accused soon realized that he can't escape ,he stopped after running away 200 meters. The deceased on reaching caught hold of his neck but before he could have done anything, he felt down on ground. Immediately he was referred to Hospital where he was declared bought dead. The accused was later arrested by Police 7 presented before trail court. the trail court framed the following Issues: a) Whether (person) accused has commited the offence of murder? b) Whether the accused was provoked by the words of deceased? c) Whether the accused had committed the grievous hurt which culminated in the death of deceased. I M from the Prosecution Side,,,So i Need help..Please Oblige..Thank You
