Grand fathers property

(Querist) 07 April 2015 This query is : Resolved
Hi

I am Govt retired employee. My grand father brought a property (not inherited) and sale deed on my father name, my brother name and my name was mentioned. No will made by my grand father and father.

my sisters are claiming that they have right on this porperty and want to go to court. Can you please tell me if they have right?

if a property is brought by grand father not sure if he brought it with his earnings or sold some property and brought a property and sale deed on grand children (me, my brother, my father) whether grand children (sisters) can claim?

Yeah.. As of your given facts your sisters have no rights to claim the property which was duly sold in favour of you and others..

Just file a suit for declaration and injunction against your sister..

It is supposed that all are Hindu.

The property belongs to your father, you and your brother. The share of your father would go to all the legal heirs squally (mother, sons and daughters).

since property came to be purchased in the names of your father, your brother and yourself, no one can claim title or share
But if they are able to prove that Grand father purchased the property in the name of Benami( persons). you have to provide share

thank you all.. we are hindu's only.
without will can we claim/consider sale deed as will? i mean will can be used as proof and rights on land?

You dont require a Will to prove your title. Since the property was purchased in in the names of all the three jointly, the three are the joint owners in it, others do not have any right to claim any share in it.
