Private complaint before magistrate

(Querist) 08 April 2015 This query is : Resolved 
I understand that a private complaint can be filed by anyone before the Judicial Magistrate under the section 200 of Cr.P.C. When the District Crime Branch Police has filed a criminal charge sheet against few persons, can I file private complaint on the same accused persons for the offences which have been already brought out by the police and the offences which were not included in the charge sheet. Please clarify.

You may file a private complaint for the offences which were not included in the charge sheet. For the rest you may not, because double jeopardy is not allowed.

even you may go for further proceedings against the police for the removed sections without lodging a fresh case..


just approach your high court by praying change of investigation. there you can alter the filed charges.
