Reservation

(Querist) 22 February 2011 This query is : Resolved
Reserve category candidates who obtained the rank of general category in merit list have been placed in the general category's select list. Whether at the time of allocation of service they can be treated as reserve category?
adv. rajeev ( rajoo ) (Expert) 22 February 2011
When there is no general category candidates available for the selection reserved category candidates will be placed in the GC. And at the time of allocation of service they will be treated as reserve category and reserve category benefits they will get.

All depends upon under what category he had applied. Applied in the General category but, shifting to the reserved category at the time of selection is not permitted.

Dear Dr. Tripathi,

A certain quota is reserved for the candidates of SC, ST & OBC candidates at the initial stage. But, if some SC/ST/OBC candidate attains merit along with the candidates of Other Castes, he gets his due rank in the merit list along with OC candidates. But due to the candidate being of the SC/ST Category, he is considered for next promotion as a reserve candidate, not as a general candidate. His being placed amongst the general candidates in the lower post does not bar his right to promotion as an SC or ST candidate for next promotion, if the posts in that category are reserved for such posts.

However, there shall be no reservation where appointments are made to posts higher than the lowest grade of Group 'A' posts and classified as scientific or technical post.

Still further, in the case of promotion by selection from one Group 'A' post to another Group 'A' post which carries the scale of pay, the maximum of which is equal to or less than the maximum of the scale of pay of a Director in the Central Secretariat Service or equivalent posts in other establishments, the officers belonging to the Scheduled Castes and the Scheduled Tribes, who are fit to hold the post and are relatively senior so as to be within the number of vacancies for which the select list is to be drawn, shall be included in such select list and considered for appointment.

Hope your query is satisfied

Being finding place in merit of general category, he can not be denied benefits of reservation in allocation of post. While allocating post he can claim benefit of reservation.
