*** please help ***

My uncle was a businessman & his wife was housewife. He bought a land in his wife’s name. She was neither present for the registration of this land purchase nor sign the purchase deed. The payment for this purchase was done by cash & it was paid by him. In the purchase deed it is clearly mentioned by seller that money is received from uncle.

He is not staying with her from several years because of her misbehavior. He is in need of money & for it he wants to sell the land. He is unable to sell it as she is not allowing him to sell it.

Please advice, how can he sell this land as the money for this land purchase was paid by him?

Your uncle should get a declaratory decree from the competent court declaring that your uncle was the absolute owner of the subject property in the event of filing a declaratory suit in this regard.
