"this is my last will" not mentioned

Hello ppl, 1. In a will there is no mention of "this is my last will." So is it valid? 2. There are 5 immovable items in a will. 1 item is transferred during lifetime. Q. This Will is still valid for the remaining 4 items?

  • It should give clear descripttion the properties bequeathed.
  • A WILL can be changed any number of times during his/her life time and the latest Will prevail over the earlier Wills.
  • Alterations to the Will can also be made at any time by the Will maker, by addition or deletion of certain points.

T. Kalaiselvan, Advocate (Advocate)     10 June 2014

If one property was transferred during the life time of the testator the Will cannot be enforceable in respect of other items/property because the purpose  of Will is bequeath entire property as per distribution mentioned in the Will, since it will not be possible to divide and distribute the property to the beneficiaries, the Will cannot be acted upon, however a probate application may be filed before a court which will decide about its validity.
