Dear sir, I have querry that, U/s 138 of NI Act, is it necessary that notice given under this should be in correct format with stating that in default complaint will be file under section 138.
As in my case legal notice is send the accused for the paymnet. But notice was involved about many acts like recovery, civil law proceedings and criminal proceedings alongwith 138 complaint.
Can it will make any problem in my case.

Notice containing composite actions under different provisions/law is perfectly valid.

Notice is perfectly valid even if contains composite actions under civil,criminal &n,i.act.

It is a double purpose notice, i.e., it can be used for NI act and also for recovery of money through a civil suit so there is no wrong in it..
