i have come to know that someone has filed a complaint against me in the court under section 156 (3) for fraud which is not correct. The person who has filed this has actually done a fraud with me and on this an investigation has been done and a FIR already registered against him in march this year

I am not aware of all the details yet, as i have only got messages from the police station (SHO) that a FIR has been made and the court has actually called for me to be arrested first and then investigation to happen. can someone guide me on the following

1. what actually happens after this.

2. what do i need to do to quash this FIR 

3. What if the police is not cooperative to me

4. do i need to get a anticipatory bail

my opinion on your queries are as under

1. what actually happens after this.

Opinion: Police can arrest you after registering FIR

 

2. what do i need to do to quash this FIR

Opinion: file a quashing petition before HC if you have very strong proof in your favour

 

3. What if the police is not cooperative to me

Opinion: File an anticipatory bail before HC or Session Court

 

4. do i need to get a anticipatory bail

Opinion: yes, you should filed.

The court never say arrest first then investigate! S h o 's false statement; 482 cr.p.c may be a good option in your case
