Hi, Here are the facts of the case:
* Married April 1999
* Feb 2000: Son born
* Jan/2001: 498a 323 34 case had been filed against me, received bail
* Lived back together approx Aug 2001-Feb 2002
* 2004: Got divorce by mutual consent, custody of son with my ex-wife, never see him due to threats from her that she will file lot more cases against me and my family if I tried.
* I have an affidavit signed by my ex-wife saying that the case against me is false, but I am afraid that she may say otherwise in court.
* She has filed other cases which are ongoing against her employer for wrongful termination (2011), and also her father for s*xual harrasment(2012)
* I have not received any summons from the court till date at my permanent address mentioned in bail application, but the online court status shows "Awaiting Summons" and hearing date 13-01-2012 (yes 2012) no new future date is shown there. I discovered this just recently.
* I do not have any lawyer for this case, lost track of the one who got me bail
My questions:
* How to go about getting this case resolved? I want to approach the court to get it quashed or present my defence
* Will there be any problem for not responding to the summons? even though not receiving it, no doubt they must have been sent to original place of residence which was rented appartment with standard 11mnths lease.
* In case I have to, how do I prove to court that I have never demanded or received any dowry as that thing has never taken place?
* How to go about finding a good/honest lawyer who has competently handled false 489a cases at Thane court, please recommend someone you have personally known.
I know this is a lot for single post, any help is appriciated.
