Hi all one of a member died in car collapse, opposite party did FIR and police attached 304a in closure report,
insurance company rejected the claim of died insured person and give reason that died person is main accused in FIR by section 304a so it would be considered as sucide so they will not give claim.
Is it so ? or we can challenge police closure report/ insurance rejection

The closure report can be strongly objected for the reasons relied upon.
You may approach an advocate and initiate appropriate action as per law.

How Section 304 A IPC can be invoked to file closure report by police, which is attracted by doing a rash and negligent act not amounting to culpable homicide, wherein deceased is stated to have died due to motor accident ? File protest petition and contest.
Insurance cannot repudiate the claim, if denied, challange it.
