Hello Experts,
My parents and I have been facing 498a, and our bail was rejected by distt court. Though we have today filed bail petition in High court however Hon'ble supreme court of India, has now amended the rule of auto arrest.
Could you please confirm when exactly the rule is effective.
Is it effective now or will take some time??

it is an observation by the hon SC against reckless arrests being made by the police, along with guidelines to be followed before making an arrest. it is not a specific judgement as such, so it would automatically be applicable to your case too, in case you have not yet been arrested. your lawyers should pursue this point in the hc in argument
