Iam facing 498a along with Dowry protection Acts.It's love marriage with out her parent's consent and just stayed for 40 days with hell lot of problems with their parents.Finally girl turned to parents side and filed a private case against me and my mother after 2 yrs of marriage.Police removed my mother from the case and iam the only one as accused.Case is in examination phase from last 6 months.For yesterday's session my wife came parents and police man and it seems they pleaded judge to fasten the case and further judge told me to wait outside and called me after 2 hrs for examination.Judge asked me a case has filed agaisnt me and asked if i have done any harassment for additional dowry.They claimed in the FIR that i have taken a dowry of 60 thousand , and harased her for additional dowry and some meaning less allegations on me.They presented Bank Statement for the 60k amount transfer to the court as proof of dowry.I have that for a domestic need and even returned that amount back after all the problems has started through post dated checks and a reciept from her with signature on revenue stamp)My questions are:
1.What would be the next steps in my case after examination?
2.How long it may take for Judgement after examination?
3.What are the chances of conviction/acquittal in my case(with below mentioned references) and in general?
- I have the reciept of 60 K for the amount that i have returened back and the xerox of post dated checks
- I have a letter from her saying that she is not intersted in divorce for which her parents are forcing her
- I have a Bank reciept for the amount she took from me for her needs after our seperation and filing the case.Also a call recording from her asking me to meet .
- They harassed us alot for settlement by arranging rowdies and threatening us for money and divorce.
- Her mother is the only witness from her side in the chargesheet submitted by police
- And initially from private complaint many sections has been mentioned,but police removed all of them and submitted the chargesheet only with 498A & DP Acts
