Hi, My father is fighting a fake case imposed on him, the said incidence has been occured on 10th April 2007.
a basic modus operandi for the fake case.
1. Complaintaint goes to the court with the complaint and a fake medico legal certificate saying my father and other person has attacked on him with knife, and he got knife injury in the abdomen. The medical certificate with the intent for the same has been shown as proof.
Contradiction: The complaintant account says, two people hit with knife, and there is only one injury of knife is shown. Based on this evidence high court has given bail.
More contradictions will explain later.
2. its been said infront of court that complaintaint went to police station and he tried to lodge the case, where police said, that "its time for election please keep calm". Complaintaint claims there was only one police hawaldar in the police station
Contradiction: a Police station clerk when came for cross examination told that this person did not go to police station after incidence.
With RTI, the information says that 10 Person including so, and circle office were present that time.
The time taken by complaintaint was 30 minutes to get examined in malkhan singh hospital Aligarh, while with RTI, RTO has verified that in a normal traffic it take arount 30 minutes to reach from place of incidence to police station and then police station to malkhan singh hospital, Aligarh. means for other activites like moving out from the place of incidence, writing letter and other activities which are bound to take 20 minutes around don't verify the claim.
Their are more contradictions for this account only.
3. While going for fake certificate from hospital, it was mandatory by the circular of Agra high commisioner, that such incident should be reported to police officer, the complaintant admits by himself, that in hospital he did not even inform the doctor about the attack, but he got the medical certificate for the same. The clothes etc evidences also not collected even till today.
4. complaintaint has put a fake receipt of speed post, where he claimed that he posted complaintant to Aligarh city SSP office. After following with the ssp office for two to three years, we got the rti from SSP office that this complaint is not received.
So by claiminng falsely that the complaintant has informed police, while he did not do so. Complaintant informed the court on 19th April 2007, after 9 days of incidence.
The proof for fake medical certificate we have.
1. The said incidence claimed to be occurred at 7 P.M on 10th April 2007. The OPD slip on which doctor has written prescripttion, are made till 2 PM at Malkhan Jila hospital, Aligarh, Uttar Pradesh.
This information we got through RTI from hospital, also the doctor in the statement in court has said the same.
2. Doctor who has made this fake certificate was not present on duty. the duty register does not have his sign. On the same time duty register has sign of Leave officer, who would take place of doctor if doctor is not present.
3.The complaintant account says, two people hit with knife, and there is only one injury of knife is shown. Based on this evidence high court has given bail.
4. Doctor who created fake medical certificate, was required to inform police, which he did not. There are circular from higher authorities, we got through RTI. This is same modus operandi, which was followed in rohatak, Hisar, in haryana, where after investigation police found around 90 fake medical certificates are created for settle down scores.
5. Doctor who created fake medical certificate in reply to RTI, says he was not aware of any circular from high authority. While in his statement in court he admits that he was aware of such circular, but he claims it got nullified. There is nothing he produced to proove that it is nullified. but on the other hand Hospital refused to give us reply for rti on this material.
We have complaint to RTI officer in lucknow. where even they are not able to help.
We need your help to unearth such a racket, which is still exists, and no body wants to do anything, because every body gets his cuts.
We may show you the proofs, evidences collected by us through RTI,and lot more to discover, to save common man from grave suffering. Every year thousand of fake cases are being filed by this way. But no body to hear. Innocent goes to jail. We don't know whom to complaint, and who will listen.
Our courts are loaded with the fake cases like this, as the person comes with money. No body wants to loose the money, hence our system would remain like this.
