Absence from court(in person&advocate)

my friend filed amarriege title suit in the family court. after two hearings o.p sent aletter to court that o.p is figting the case.but after two hearings nither o.p or advocate not present.can the court pronounce an ex-party order and proceed.If supporting jugments are avilable plese give number or links.

Family Court in such circumstance will proceed ex-parte and fix date for recording of the ex-parte evidence of the petitioner, decide the case after that on the basis of pleadings and evidence on record.

This the usual practise carried by the trail court in such cricumstances.
