Actually most of the times, direct evidence is not available and hence need to be proved by circumstantial evidence,

What evidences you have, show it to a learned lawyer and decide accordingly.

Though i can not rember the exact citation, but i read one such judgment:

One couple was caught red handed in comromising position, case was contested. The defense came with the idea that S*XUAL INTERCOURSE WAS NOT PROVED. All the eyewitness confirm semi naked bodies + compromising position, but where is intercourse? So no punishment unless crime is proved beyond doubt.....its a criminal proceeding u know!

Adultery cannot be proved unless there is a concrete proof for  S.intercourse. Uless there is a proof of abortion or child born out of wedlock. It is difficult to prove adultery. Unless it is admitted by the parties to the adultery.

You are missing a point my dear friends.

Proof of adultery for divorce and proof of adultery for punishment are different.

Divorce can be granted on the pre-ponderance of possibility. Whereas for conviction strict proof is required.
