No, the police have to lodge an FIR. The sections involved will come under the Motor Vehicle Act, 2019. If the police deny to lodge an FIR, you can go to the SP's office or make a formal complaint to the nearest judicial magistrate who will direct the police to lodge an FIR.

The sections in such acident do not attract the sections of Motor Vehicle Act rather the section of Indian Penal Code are attracted like section 279, 337 & 338 of IPC.
Move your application before higher police officials complaining against the relevant police personnnel who are illegally pressuring you for the compromise against your wishes.
