accident claim

I sold my car and transferred
ownership a year before. Now new owner met accident and claim has been sought in court and I am also made a party. am i liable to pay any compensation

When a motor vehichle is transferred, the owner should ensure that the vehicle is transferred in the name of the new owner duly signing the required RTO forms. In addition, the owner should take a receipt for having taken over the vehicle on purchasing fromthe new owner duly mentioning the date and time of such taking over.

 

In the instant case, you may appear before the Court and inform the actual position when you sold the vehicle, with proof of such sale and explainthe reasons for not transferring the vehicle in the name of new owner.  If transfer did take place before the accident, the fact of such transfer may be brought to the notice of the Court for appropriate decision.
