Accident claim..mediclaim or compensation ?

 

Dear Friends,

My mom had an accident and fractured her leg a day 20 days ago. It was all due to negligence of a tanker driver who dashed a wall and the wall fell on my mom's leg. We have filed a complaint against the tanker supplier and driver with the police. This all happended in dist thane. My questions are :

 

1) My mother has a mediclaim policy and we are planning to submit the claim to the insurance company. In the meantime a lawyer approached us saying that not to submit the claim to my mother insurance policy but to submit the claim to the Transport agency (who owned the tanker and who caused the accident) who have their motor insurance policy. The reason being as per lawyer that we will get 100% amount of expense incurred plus disability amount and other compensation. Whereas my mother's mediclaim amt won't reimburse all expenses.

Hence i am in a state of confusion. Please suggest me what is a better option.

 

2) As per the lawyer he is assuring that we will get the reimbursement +disability compensation within 2-3 months. Please suggest if its true or we need to visit court for that.

your seem to be more interested in a losing bargain otherwise should have no doubt to what lawyer advised.

You may go for claims under Insurance policy of tanker as advised by the lawyer.  However, it may take some more time as promised by the lawyer.

Hello Sudhir Sir, 

Yes I am not interested in being in the middle of the road with me standing with no mediclaim insurance nor the compensation provide by the tanker agency. Since i need to submit my original bills to mediclaim insurance within 30 days i want to make sure what the lawyer or whatever the law is if its 100% sure that i will get the compensation. If its not 100% sure and i have to fight it out in the court of law by visitng the court everyday to get the compensation then i will not want to go that way. Hence needed your suggestion.
