Accused were removed from cs, but still was issued summons

Dear experts,

Accused names were deleted from Charge sheet after having all the arguments. But again, they were called to court, after receiving a petition from the opposition. 

Does not this act devoid of honoring constitutional rights. 

Is there anything that one can do to oppose the Honorable Judge, who acted with a biased intent.

There is  no constitutional devoid, aggrieved party can always move appellate court against this summon.
