Add spouse name in the flat

Hi Friends,

Ours is an 40 year blg in Mumbai and the flat was bought by my father and mother. My father passed away 25 years ago and my name was added to the flat. Now, my mother passed away and I would like to add my spouse name to the flat so that there are always two owners for the same. Can you let me know the process.

Do I need to do a registration again and pay stamp duty again. If so what are the details. Also is it advisable to add my son also to it so that I don't have to repeat the process again.

Thanks in advance for your expert help.

Married couples usually own most, if not all, of their valuable property together. If you want to leave everything to your spouse, as many people do, you don't need to worry about what belongs to you and what belongs to your spouse. If you'd rather divide your property among several beneficiaries, you'll need to know just what's yours to leave. You and your wife names are enough for owning the property.

1)You can not mutate wife's name to your ancestral property ,but son's name.

2) If you wish wife to be a co-owner in your ancestral property, transfer half share to their name by way of gift deed and then registration and stamp duty be paid for the same.

Thanking you,
