Additional affidevit in case of section 138

i am defendent in a case under section 138, the complaintant is a limited company. initially the company did not filed any authority letter to the director in whose name the complaint was submitted, it was filed after ten months and that too on a simple letter head without the copy of resolution. after some time the said director after not able to answer the primary questions left the company and another director who is cmd appeared in his place. he also did not submitted ay evidence as demanded by my counsel but in place have submitted the a part of email corrospondence held between us whih were never mentioned in the primary application and now have submitted an application to allow the additional affidevit taking a plea that as he has changed his counsel. as per law can he do it?

It is the court discretion whether to accept it or not.
