In a civil suit my opposit party filed an affidavit, which latter proved to be false.
Now, I want to file a petition to the same civil court (trial court) praying that the said affidavit be forwarded to a crimenal court of proper juridection, to be tried under the proper sections of IPC.
Please advice me the procedures involved and the relevant sections of CrPC and IPC.

A complaint u/s 340 r.w 195 oif CrPC should be preferred in the same court.
