Advise please

Dear Experienced Lawyers,

I filed a civil & criminal case on december 2010. My lawyer is not answering even the voida dates. I wish to change my lawyer and what is the procedure for that? If any lawyers who is sincere and loyal to his profession then answer my question.

I hope all the lawyers are not in that kind of my lawyer and i am really unhappy that why i went to the court instead of approaching local politicians to get my money back?

Dear Mr Kumar,

The ideal situation to change a counsel would be, if you can obtain a NOC from the said counsel. But as you have mentioned the counsel is not responding to your calls and is not appearing in the matter. You may appoint a new counsel and send a letter through registered post to the counsel discharging him from the cases and revoking the rights to contest on your behalf. 

 

He may appear in court and object to the same, but I think that would be unlikely in the given sitation.
