After divorce dismissal

DEAR ALL,

MY HUSBAND'S DIVORCE CASE WAS DISMISSED DUE TO THE REASN HE DID NOT PROVED THE ALLEGATIONS,WHEREAS I  HAVE PROVED MY SIDE POINTS.

AFTER CASE DISMIISAL (ITS NEARLY 50 DAYS OVER) HE DIDN'T GO FOR APPEAL AND MYSELF ALONG WITH MY CHILD GOING TO FILE FOR MAINTENANCE.

PLEASE GUIDE ME.

what difference is it going to make if he appeals or not

if he appeals - you have to  slug  it out in the court again

if he doenst appeal - so what - you still cannot force him to stay with you, what will the court do? the court cannot chain him wiith you in one room, the court will only make arrangememnt for your 'roti - kapdaa - makaan' that too within his means of earning, and if you are earning then even that wont be provided.

you will file maintainence - and will gain some kind of monetary compensation....aage kya?

so what have you gained by contesting his divorce - you have lost him physically, emotionally - only on paper he remains your husband, and he will provide you money until you get married or find work...........

what did you gain - just some thousand rupees monthly,,but you have lost your husband forever, because even after dismissal, i bet, he will never return to you again. and the court will not force him to stay with you, and you are left with a husband who has deserted you, and a 'married; tag that wont allow you to get married again.

you are trapped by your own decision to contest his divorce, ....................................all the best for your future

Maintenance you can claim only if you are not working woman u/s 125 crpc .


If you are working and still claim maintenance, cat and mouse game will begin.


One day somehow husband will prove that you are working or capable of working, then no maintenance to you, but for child both of you have to contribute towards maintenance.


Next time do not use caps lock for typing your query.  It feels as though you are not asking suggestions, but demanding it.

 . u didnot told us on what grounds he filed divorce,  If u r willing to co habite with him u can do, if no if u not willing u can file maintanence petition.
