i m accused in 498, after our statement u.313 the court call medical officer for examiantion. doctor deposed that complaint lady come along with police note and she stated that she was assualt by 2 people. wherein his medical report history says "h/o assualt by 2 people".
only on this statement of doctor, the accused statement by re-recorded u.313 crpc only for this instant. My thinking is that since there was no name of accused mentioned in the medical report nor on his deposition, so accused statement will not recorded again only for this.
