Agreement breach

The party can sue other party on the failure of implementation of agreement. The distinction between the two lies in the burden of proof and the damages claims. In a breach of contract case, the claimant must prove the violation of the contract and claim the liquidated damages that were agreed upon in the contract, while in a tort case, fault liability and actual loss must be proved by the claimant according to law.
