Is agriculture land mortgage to private / indiviual lending is legal. My father has 5 acre agriculture land in 1987 he has mortgaged to private lender for Rs.7000/- and the mortgage is registered. The lender had filed the case to recover the money from my father court has given direction to recover money from my father. At that time my father was not in service the govt department write a letter to the court mentionining he was removed from the service.
Due to transferable job my father has not able to visit the agriculture land almost 30 years. Now we want to settle mortgage to private lender and get back the property.
Please help me in what are the steps to get back our property.
