Alimony

Respected experts, The Hon Supreme Court in its order has fixed an amount of Rs 10 lacs as one time settlement (alimony) and vacate the flat within 1 month she was occupying. But she has refused to comply with the order. She has neither accepted the amount nor has vacated the flat. Under this circumstances what action can be undertaken. Regards.

Hello,

Since the order of the court is not complied with, in this case you must file an execution application before the said court to issue directions to parties in contempt. But, before you file any such application, issue a legal notice to such party asking them to comply with said order.

Thanks. You mean to say that the execution petition needs to be filed in the Hon Supreme Court ? Or need to initiate contempt proceedings ?

Please issue a legal notice to the party concerned through your counsel and file execution petition in the same court.
