Alimony payment

Hi,

I need a quick question answered by an expert adviser in family matters.  I and my ex-wife got divorced 24 years back on grounds of mutual incompatibility.  Since then the wife has been staying in my apartment in Mumbai, receiving regular maintenance through bank transfer even after the two kids have grown up and flown away.  The court order was that she will vacate the apartment once I pay her Rs.5 lakhs lum sum, which I did back in 1995, and which she refused to accept and things moved on becasue the kids were small then.

Now I need the aprtment for my own accommodation and she says she has not earned or saved anything to buy her own.

What is the legal route to resolve this, preferably amicably, without buring a hole in my pocket as I have resettled now.

I will appreciate good advise soon.

why dint you move to court when she refused to accept the lump sum amount ? After payment of 5L what happens to monthly maintenance ?

Please share more details on the maintenance/alimony granted.

As per court order no maintenance is to be paid after the 5L lump sum alimony. The alimony was based on cost of living and cost of house back in early 1990s.

Why i didn't go to court then? Sheer ignorance, lack of proper advise.

Further advise solicited.
