Ancestoral property partition

We are a Hindu family of four brothers. The pattas of the agricultural lands are made in the names of the four brothers due to land ceiling act. One portion of the land (around 18 acres) had a legal problem and presently the court has passed judgement favouring our family.

The family wishes to partition this land among four brothers. What will happen, if the land is partitiioned and the legal issue geos for an appeal to HIgh Court?

You are free to partition the property decreed to your family with the existing court decree. In case, if the defendents/plaintiffs of the suit decide to go for an appeal, the outcome will then depend on the judgement of the HC. At present , you are legally entitled to enjoy the property and hence try to partition the property as early as possible.
