Ancestral property

hello sir /madam, my maternal granfather had his share from his ancestral property, he wrote a will towards my mother.which she came to know few year latter his death. he also had other childrens. now they are asking for a share. is my mother has the rights to that property according to the will. can anybody give adivce please. thankyou

dear querist,

your maternal grand father was free to make will of his share in ancessotral property and so as your mother now,if the mutation had entered in name of other children your mother can claim her share by probating the said will.other children can not deny her right by virtue of  her  father's will.

IF it was ancestral property, and the parties are hindu, your mother's father came to share the property equally with his children as soon as he got it, hence if the property still stands unpartitioned - then your mother as well as other siblings have an equal stake in the same.

my maternal granfather's father was a hindu, when he died he didn't make a will, so all his children divided his property equally, and my maternal granfather became a christian long before his death, so how is this going to affect if he had made a will towards my mother only, whereas my grandfather has four other childrens. they are appealing in the court for equal distribution of the property. how is this going to affect my mother in using the property. what will happen for the will. can someone give advice how to deal with this issue.
