A person was allotted a BDA PLOT in 1975 by City Improvement Trust Board (erstwhile BDA). Lease cum Sale Agreement entered mentions that the plot should be used for construction of Dwelling House for human occupation and construction of apartments, factories are not allowed. The property was conveyed to him vide registered Sale Deed after completion of lease period in 1982.
He sells the plot in 1995 and that subsequent purchaser had built apartment (residential ) in the year 2014-15 after obtaining plan approval from BBMP.
My question is does the clause mentioned above regarding bar placed on construction of apartments on BDA plot is applicable to subsequent owner or is it only to initial allotee ?
