Apply: bangalore devl. authority site

Dear Advisors,

My father in-law, who is 64 years old, wants to apply for a Bangalore Development Authority (BDA) site (80X50 size plot in their new development). He currently co-owns an apartment with my wife. The payment for which was made initially by him, but mostly by her. The apartment in question is completely paid for.

My question is: Is he eligible to apply for a BDA site?

This is what is written in the FAQ section of BDA:

Any person, whose family members or dependant of the family owns a site or a house or has been allotted a house or site by BDA or a Co-operative Society registered under the Karnataka Co-operative Society Act, 1959 or any such other Authority within the Bangalore Metropolitan Area has been allotted a site or a house in any part of the State by any other Urban Development Authority or the Karnataka Housing Board or such other Agency of the Government are not be eligible to apply for allotment of a BDA site.

Your opinions on this matter is highly appreciated.

Thanks

Manuj
