Appraisal after resignation

Hi,

I am working in an organization since 3.5 years.

Our Appraisal/ increment is effective from April 1, 2014.

Our performance rating has been discussed and an appraisal form has been forwarded to HR by my immediate superior in May 2014.

We didn't receive any letter till June 11, 2014. In the meanwhile I received a good offer and i have resigned from my current position.

I spoke to the HR regarding whether i will receive appraisal letter and arrears from April 2014 till the date of my relieve. The Hr denied saying that as i am on notice period of 45 days, my appraisal will be on hold and i shall not receive the increment or arrears according to policy.

I have reviewed the company policy and according to the policy, the appraisal should be done before 28th Feb of the year. No clause on resignation has been included.

I need to serve my notice period till July, 2014 and in between they shall release the appraisal letter to others.

The HR has not circulated an e-mail about the delay in the appraisal process and the time frame when they shall release the appraisal letter.

Is there a legal way out to this problem and claim the arrears?

Do you have copy of appraisal and matrix for appraisal and increment?

If not acquire a copy.

It is duty of the bosses to conduct appraisal well in advance and it is well stated in company’s policy too. If company has not followed then it is breach by company.

You can stake a claim.

Obtain all relieving docs with good comments on conduct and performance (avoid without comments/with adverse comments) and decline to accept FnF statement.

 

If HR personnel is at fault you can always escalate to good offices of appointing authority, MD, CEO and no relief is provided by good offices then you can approach your lawyer and lawful authority.
