Arbitration act 34[3]

in a case a lady could not collect decision copy of arbitration through her lawyer within 90 days after decision.

with the help of from another lawyer-she collected decison copy after 18 months .sec 34 3 of arbitration act reckons period of 90days from receipt of decion copy.

can the lady may pray condonation of delay of 18 months due to change of lawyer -hence delay in recipt of copy.will it sufficient to put argue for condonation of delay .pl guide

No,sec 5 of limitation Act does not apply in the proceedings u/a 34 of Arbitration and Conciliation Act.Award can only be challenged within prescribed period and after expiry of that period petition u/a 34 of Act is not maintainable.
