As a landlord how can i sort these issues with tenants

 

Respected sire,

we are landlords of a property in Mumbai. Our tenants are all under old pagdi system so they are protected by rent control act.

I am aware that Rent control Act does not allow me to evict them. But I would like to know what i can do for following:

a) Some of them have come as a tenancy transfer just few years back. Is there some rule that says that if a rent agreement is after so and so year , i can serve notice and ask the tenat to leave.

b) Some old pagdi tenants do not even have agreements but i have been giving rent receipts. Can I evict those tenants who have nop agreement.

c) Is there a body of lawyers I can approach ( as a retired person with no major income) who can fight my case and get me a fair rent, clean up all illegal tenants etc.

dear querist,

no doubt tenants are protected by rent control act but same act also provides safegaurds for the rights of the landlord.you can file for eviction as well as also for the hike in the rent by filing suit for valuation of the rent considering the market value and adjoining property rents.you may contact to sutapa saha at mumbai on 9820658491
