Banking Ombudsman - Rejecting complaint

Hello 

 

Recently the banking  ombudsman has  refused to    entertain a complaint  against  a   Bank in Credit Card  dispute . The reason  for rejection is clause   c of para   9  which reads as under

 

"(c) the complaint is not in respect of the same cause of action which was
settled or dealt with on merits by the Banking Ombudsman in any previous
proceedings whether or not received from the same complainant or along
with one or more complainants or one or more of the parties concerned with
the cause of action;"

 

In this case it was the bank which had gone to lok adalat and not the customer .  

There has been no   conclusion in lok adalat as well  as the  Bank  power of attorney was absent  

 

is the ombudsman office  correct  in doing this . what is the recourse for the customer .
