Basic salary

I want to know how the basic salary of any employee can be decided (legal base) ? I know the structure of minimum wages and DA that is declared by Govt. labour dept. But for PF concern how to make basic + DA from the total wages paid to an employee ? also can we pay any employee only 26 days salary in every month excluding sundays + National holidays ?

Basic salary should not be less than the prescribed minimum wages of respective state.

All statutory contributions and dedection including PF, gratuity and bonus should be on basic wages which should not be less than the minimum wages of respective state.

Monthly salary should be paid for 30 days.

In addition to Mr. Sinha's reply, I may add that according to labour laws, you have to allow one paid weekly off after 6 working days, besides the predetermined holidays. So, you have to pay full month's salary to every worker in any case, if he is working on regular basis.
